Applicability of the ACT 520

Lembaga Pembangunan Industri Pembinaan Malaysia ACT 1994 [ACT 520]

The ACT 520 applies throughout Malaysia with the following relevant Sections established as provisions and regulations for Registered Contractors:

Parts   Summary
I   Interpretation [of “Contractor”, “Construction Industry”, “Construction Site Supervisor”, “Construction Works” and “Skilled Construction Worker”]
II   Functions of CIDB featuring its implications on CIDB’s role in the Construction Industry.
IV   Registration of Contractors, featuring mandatory requirement for Contractors to register with CIDB, obligation of contractors to co-operate with Lembaga. Lembaga may serve by notice in the prescribed form if contractors fail to comply with requirement of the ACT.
On the other hand, a provision stipulated in this Section maintains the necessity for CIDB to manage a “Register” containing details of registered contractors. This “Register” is referenced as the Local and Foreign Contractors in their respective Directories.
VII   Accreditation and Certification of Skilled Construction Workers and Construction Site Supervisors, with specific mention of Construction Workers’ skills / trades as Concretor, Bar-bender, Carpenter, Bricklayer/Mason, Plasterer/Pavior, Tiler, Painter, Joiner, Metalworker, Drainlayer, Glazier, Welder, Construction Plant Operator, Plumber and Licensed Electrician.
Upon Accreditation and Certification, these Skilled Construction Workers will be registered as Trade Contractors. In this respect, a provision has been established for CIDB to maintain a “Register” of Trade Contractors and List of Trades.
IX   Enforcement and Investigation, where Investigating Officers are empowered to carry out investigations of any offence or necessary inspections at the Construction Site, in particular, questions concerning the registration of the Contractor, accreditation and certification of the skilled Construction workers and construction site supervisors or the payment of Levy.
X   General, where highlights CIDB’s empowerment to make any regulations as necessary for the better carrying out of the provisions of the ACT.
